Waiver, Release of Liability & Policies
Markos Mkrtchyan dba Golden State Tennis Academy · (747) 336-1223 · elite.trainingss1@gmail.com
By booking or taking part in a lesson or class, you agree to the following. If the participant is under 18, the parent or legal guardian agrees on the participant’s behalf and on their own behalf.
1. Assumption of risk
Tennis is a physical activity with inherent risks, including slips, trips and falls; collisions with people, fencing, net posts or equipment; being struck by a ball or racquet; sprains, strains, fractures and other injury; heat illness, dehydration and sun exposure; cardiac events; injury caused by court surface or weather; and, in rare cases, serious injury, permanent disability or death. These risks cannot be eliminated. I knowingly and voluntarily assume all such risks, known and unknown.
2. Release of liability
I release, waive and discharge Golden State Tennis Academy, Markos Mkrtchyan, and its coaches, employees, independent contractors, agents and volunteers (the “Released Parties”) from all claims arising out of or related to participation, including claims arising from the ordinary negligence of the Released Parties. This release does not apply to gross negligence, recklessness or wilful misconduct.
3. Facility owners
This release extends equally to the owners and operators of any facility used by the Academy, including the City of Los Angeles, its Department of Recreation and Parks and its officers, agents, employees and volunteers, and any school district or other venue.
4. Indemnity
I agree to indemnify, defend and hold harmless the Released Parties from any claim brought by me or on my behalf, or by the participant, arising out of participation.
5. Medical
I authorise the Academy to arrange emergency medical treatment if needed and accept financial responsibility for it. I confirm the participant is medically fit to take part and will tell the coach about any condition, allergy or medication that matters.
6. Rules and conduct
The participant will follow Academy, facility and City rules and the coach’s direction. A participant may be removed for conduct that endangers others.
7. Players under 18
A parent or legal guardian must stay on site and within sight of the court for the entire session.
8. Photos
The Academy may take photos or video during classes for promotion. If you do not want the participant to appear, tell the coach or text (747) 336-1223 and we will not use their image.
9. Fees, cancellations and refunds
Lessons are paid at the lesson, by cash or Zelle. A 3-lesson package is paid upfront and is non-refundable once the first lesson is played; unused lessons can be rescheduled with 24 hours’ notice and are valid for 8 weeks. Cancellations with less than 24 hours’ notice, and no-shows, count as a played lesson. If the Academy cancels (including for rain), the lesson is rescheduled or credited.
10. Agreement
This is the entire agreement between the parties and is governed by the laws of the State of California. If any part is unenforceable, the rest remains in force. Booking a lesson online, or signing a paper copy at the court, is your agreement. A paper copy is available at any lesson on request.
